Bettendorf subdivision developer fined $6,000 by Iowa DNR to settle storm water permit violations

Ven Green Land Development LLC – developer of the Spencer Hollow residential subdivision in north Bettendorf – has agreed to pay $6,000 to settle storm water runoff permit violations that occurred in July 2020.

According to the administrative consent order issued March 9, the Iowa Department of Natural Resources (IDNR) received a complaint July 15 of last year alleging water in a tributary to Spencer Creek was brown from silt that had run off from the housing subdivision.

An Iowa DNR staff member investigated the complaint July 17 and and July 20 and observed that "silt fences had failed in several places around the perimeter of the site. In multiple locations a flow path of tan sediment was observed from the site to the creek."

The inspector also reported that portions of the subdivision site were not properly stabilized.

According to the report, "A a large area under a bulk fuel tank trailer was stained with diesel fuel, this was not documented in the weekly inspections required by the Storm Water Pollution Prevention Plan (SWPPP) further a mandatory spill report was not received by the department; and sediment was observed in the street."

In addition to the Ven Green Development group, Nick Kremer of Kremer Construction Company was named as a party in the administrative consent order.
